Getting Your Workers’ Compensation Benefits

If your work-related injury or occupational disease causes you to miss more than three days, or three shifts, at work, you qualify to receive benefits. It does not matter who was at fault in causing your injury or illness. Even if you were at fault, you are eligible to receive benefits under the Colorado workers’ compensation system.

If your company does not have insurance, but you were hired by a contractor, you may have the right to collect benefits through the contractor. If the negligence of a third party caused your injury or disease, you may be able to sue for benefits and other compensation.

Types Of Disability Benefits

Initially, there are two types of benefits (partial or total) you may qualify for based on the seriousness of your injury or disease and the number of days you are unable to perform normal job functions. These are known as wage replacement benefits, and they are not taxable. If you have two or more jobs you will not be able to work, wages from both should be calculated in your benefit payments.

  • Temporary partial disability (TPD): Benefits are available if you are injured and unable to return for full wages, but you can work part time by modifying your job functions. Your benefit rate will be two-thirds of the difference between average weekly wages at the time of your reported injury or disease and the reduced wages you receive until you are able to earn full wages again.
  • Temporary total disability (TTD): Benefits include two-thirds of your average weekly wages at the time of your reported injury or disease, and are payable for up to one year as long as you are totally unable to work.

Once your authorized treating doctor determines you have reached maximum medical improvement (MMI), meaning your injury or disease has become stable, you may be awarded additional benefits for permanent disability if your condition cannot be improved.

  • Permanent partial disability (PPD): Compensation may be available if your permanent impairment allows you to return to some kind of work, but your treating doctor still concludes you suffer from either a scheduled impairment (“loss of function affecting the toes, feet, legs, fingers, hands, arms, teeth, vision or deafness”) or whole person impairment (“loss of function affecting body parts not listed on the schedule above, such as the spine, lungs and mental impairment”). Compensation for a scar or disfigurement caused by your work injury may also be available.
  • Permanent total disability (PTD): Available if you are completely unable to return to your job or any other type of wage-earning work. You may be eligible for lifetime disability payments at the amount of two-thirds of your average weekly wages at the time of your reported injury or disease and based on your life expectancy.
